NOTICE is hereby given that the Cottonwood Heights Community and Economic Development Director or designee will hold an Administrative Hearing Meeting on Wednesday, August 21, 2019, beginning at 12:00 p.m. in Room 5 (Council Chambers) located at 2277 E. Bengal Blvd., Cottonwood Heights, Utah.

Meeting Procedures

Items will generally be heard in the following order:

  1. Staff Presentation
  2. Applicant Presentation
  3. Open Public Hearing (if item has been noticed for public hearing). Each speaker during the public hearing will be limited to three minutes.
  4. Close Public Hearing
  5. Community and Economic Development Director Deliberation
  6. Community and Economic Development Director Decision

Administrative Hearing applications may be tabled if: 1) Additional information is needed in order to act on the item; OR 2) The Community and Economic Development Director feels there are unresolved issues that may need further attention before the Director is ready to make a decision. The Community and Economic Development Director may carry over agenda items to the next regularly scheduled meeting.

Submission of Written Public Comment

Written comments on any agenda item should be received by the Cottonwood Heights Community and Economic Development Department no later than the Tuesday prior to the meeting at noon. Comments should be emailed to ahulka@ch.utah.gov. After the public hearing has been closed, the Community and Economic Development Director will not accept any additional written or verbal comments on the application.

COTTONWOOD HEIGHTS – INITIATIVE INFORMATION PAMPHLET

On May 24, 2019, an application for a citizen’s initiative (the "Application") was filed with the office of the Cottonwood Heights city recorder. As explained below, an "initiative" is a new law proposed for adoption by the public through a petitioning and verification process which, if it successful, can result in the new law appearing on an upcoming ballot for approval or rejection by the voters. The initiative process is governed by Utah state law, which specifies the exact steps, standards and timetables which must be followed by both the proponents of the initiative and the governmental entity. 

If this initiative process ultimately is successful under the applicable state statutes, then it is anticipated that the proposed new law will be included on the ballot for the municipal general election scheduled for November 5, 2021. The timing of the election is, again, a function of state law. 

Utah state law governing the initiative process provides that (a) the citizen "sponsors" of the initiative may provide a written argument in favor of the initiative, (b) the city may provide a written argument against the proposed initiative, and (c) the city's election officer (here, the city recorder) then compiles, publishes and publicly distributes a written information pamphlet which contains the Application, the "for" argument, the "against" argument, and a fiscal/legal impact statement prepared by the city's budget officer and attorney. Those items follow as part of this information pamphlet.

 2019 Notice Of Municipal Election

In accordance with Utah Code Ann. 10-3-301, notice is hereby given that the following municipal offices are to be voted upon in the Cottonwood Heights 2019 municipal election:

  • Council District 1
  • Council District 2

All positions are for a four-year term.

The filing window for eligible candidates to file a declaration of candidacy is June 3 through 9, 2019 during regular office business hours of 8 a.m. to 5 p.m. Candidate eligibility and filing requirements are outlined on the city website at:http://cottonwoodheights.utah.gov/public_records.election.html.

A primary election will be held (if necessary) on August 13, 2019. The general election will take place on November 5, 2019.

Cottonwood Heights utilizes voting by mail. Prior to elections, ballots will be sent to voters on or about July 16, 2019 for the primary election (if necessary) and on or about October 8, 2019 for the general election.
